Rule 398 requires the Recorder to select a Judge "as soon as possible", and then to distribute the statement to be judged and the identity of the Judge to all players. J(39) was distributed without the identity of a Judge, meaning either that Colin failed to select a Judge "as soon as possible" or that he failed to then distribute the identity of that Judge.
